1. Scope
These General Terms and Conditions (hereinafter "GTC") apply to all orders placed through the online shop of MVP Swiss AG (hereinafter "Provider" or "we"), Grabenstrasse 15A, 6340 Baar, Switzerland.
The contractual partner of the customer is MVP Swiss AG. These terms and conditions apply to consumers and entrepreneurs, unless expressly stipulated otherwise.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.
An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. By clicking the "Buy" or "Order with obligation to pay" button, you submit a binding order for the goods contained in the shopping cart.
The contract is concluded in the following steps:
1. Selection of the desired goods and placing them in the shopping cart
2. Press the "Checkout" button
3. Entering the billing and shipping address
4. Selection of Payment Method
5. Verification of all information
6. Binding order by clicking the "Buy" or "Order with obligation to pay" button
After placing your order, you will receive an automatic order confirmation by email, confirming the receipt of your order. This order confirmation does not yet constitute acceptance of your offer.
The purchase contract is only concluded upon our declaration of acceptance, which takes place in a separate email or through the delivery of the goods.
3. Prices and Payment Terms
All prices include the statutory value-added tax and other price components. Shipping costs are added, which are indicated on the respective product page and during the ordering process.
For deliveries to countries outside Switzerland, additional customs duties, taxes, or fees may apply, which are not collected or charged by us but must be paid directly by you to the relevant customs or tax authorities.

When paying by credit card, the charge is made upon conclusion of the contract. For other payment methods, the respective terms and conditions of the payment service provider apply.
4. Delivery and Shipping
Die Lieferung erfolgt an die von Ihnen angegebene Lieferadresse. Die Lieferzeit beträgt in der Regel:
- Switzerland: 2-5 business days
- EU: 5-10 business days
- Worldwide: 7-14 business days
Die angegebenen Lieferzeiten sind Richtwerte und können in Einzelfällen abweichen.
Shipping costs are calculated based on the delivery country and weight and will be displayed to you before completing the order.
We ship with the following service providers:
- Switzerland: Swiss Post
- EU: DHL, DPD
- Worldwide: DHL Express
The risk of accidental loss and accidental deterioration of the sold item passes to you upon delivery of the item to the carrier, the freight forwarder, or any other person or institution designated to carry out the shipment.
5. Retention of titlet
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung aller Forderungen unser Eigentum.
6. Warranty
The statutory warranty provisions apply. For consumers, the warranty period is two years from the receipt of the goods.
Offensive defects must be reported to us immediately, at the latest within two weeks after receipt of the goods, in writing. Hidden defects must be reported immediately after discovery.
7. Liability
Our liability for damages that are not based on injury to life, body, or health and that are not based on intentional or grossly negligent breach of duty on our part or that of our vicarious agents is excluded.
Liability for slight negligence is excluded, unless essential contractual obligations are affected, the breach of which endangers the achievement of the contract's purpose or whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contracting party may regularly rely.
8. Special Provisions for Dietary Supplements
Dietary supplements are not a substitute for a balanced and varied diet as well as a healthy lifestyle. The stated recommended daily intake must not be exceeded.
Nutritional supplements should be kept out of reach of small children.
In case of pregnancy, breastfeeding, medication intake, or existing medical conditions, a doctor should be consulted before use.
9. Special Provisions for Cosmetics
Cosmetic products are intended for external use only. In case of skin irritation or allergic reactions, discontinue use immediately.
Before first use, a compatibility test should be performed on a small area of skin.
10. Special Provisions for Chemicals
Chemical products must be used in accordance with the safety data sheets and instructions for use. The products must be kept out of reach of children.
When using, the appropriate safety measures must be observed. In case of doubt, please contact our customer service.
11. Right of Withdrawal
Für Verbraucher in der EU gilt das gesetzliche Widerrufsrecht gemäß unserer separaten Widerrufsbelehrung.
For customers in Switzerland, there is no statutory right of withdrawal.
The right of withdrawal is excluded for goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery. This particularly applies to our products in the categories of dietary supplements, cosmetics, and chemicals.
12. Data Protection
We process your personal data in accordance with our privacy policy, which you can view in our online shop.
13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
14. Applicable Law and Jurisdiction
For all legal relationships between us and the customer, Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is Zug, Switzerland, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law, or has their residence or habitual abode outside Switzerland, or if the residence or habitual abode is unknown at the time the lawsuit is filed.
Für Verbraucher mit Wohnsitz in der EU gelten die zwingenden verbraucherschutzrechtlichen Bestimmungen des Wohnsitzlandes.
15. Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the economic purpose of the invalid or unenforceable provision.
16. Changes to the Terms and Conditions
We reserve the right to change these terms and conditions at any time. The amended terms and conditions will be communicated to you by email and will be deemed approved if you do not object within six weeks of receipt of the notification.
